Terms of Service

Hushed and Unheard, PLLC | Direct Primary Care

Effective Date: April 13, 2026

These terms explain important membership and billing policies. Submitting an enrollment form or payment information does not by itself activate membership. Membership begins only after the practice accepts the enrollment, confirms applicable fees, and the required Direct Primary Care agreement is acknowledged or signed.

1. Not Insurance

Hushed and Unheard, PLLC is a Direct Primary Care (DPC) practice operating under N.C. Gen. Stat. § 58-3-8.

DPC membership is not health insurance and does not replace health insurance.

Patients are strongly encouraged to maintain active health insurance coverage for services not provided by this practice, including but not limited to emergency care, hospitalizations, specialist services, and advanced imaging.


2. Membership & Billing Authorization

By enrolling, you authorize Hushed and Unheard, PLLC to charge the payment method you provide for:

  • A one-time enrollment fee (non-refundable)
  • Recurring monthly membership fees, billed automatically each billing cycle

You understand and agree:

  • Charges will occur automatically unless membership is properly canceled
  • You are responsible for maintaining a valid payment method on file
  • Failed or declined payments may result in suspension or termination of services
  • By completing enrollment, you acknowledge that you have read, understood, and agree to these Terms prior to being charged.

3. No Refund Policy

All payments are non-refundable once processed, including:

  • Enrollment fees
  • Monthly membership fees

No prorated refunds will be issued for partial months, unused services, or early termination.


4. Membership Commitment & Cancellation

A minimum three (3) month commitment is required at the time of enrollment.

After the initial commitment period, membership will continue on a month-to-month basis unless terminated by either party.

To cancel membership:

  • Written notice must be provided (email, text, or written communication)
  • Notice must be received at least thirty (30) days prior to the next billing cycle

The 30-day notice period begins on the date notice is received.

During this time:

  • Membership fees will continue to be billed
  • Access to services will remain active through the end of the final billing cycle

Failure to provide proper notice will result in continued billing.


5. Re-Enrollment

If membership is canceled and later restarted:

  • A re-enrollment fee will apply
  • Hushed and Unheard, PLLC reserves the right to deny re-enrollment based on:
    • Prior payment history
    • Misuse of services
    • Disruptive or inappropriate behavior

6. Scope of Services

Membership includes services outlined under your selected plan.

Services not included may include, but are not limited to:

  • Emergency services
  • Hospital care
  • Specialist visits
  • Imaging and procedures performed outside the clinic
  • Medications and certain labs

These services remain the responsibility of the patient.


7. Clinical Discretion

All care is provided based on:

  • Clinical judgment
  • Medical appropriateness
  • Provider availability

Membership does not guarantee specific outcomes, treatments, or unlimited access at all times.


8. Communication & Non-Emergency Use

Communication methods (including phone, text, or messaging) are provided for convenience and non-emergency use only.

In the event of a medical emergency:
Call 911 or go to the nearest emergency department.

Hushed and Unheard, PLLC is not responsible for outcomes related to delayed emergency care.


9. Patient Responsibilities

By enrolling, you agree to:

  • Provide accurate and complete medical information
  • Complete all required intake and consent forms
  • Maintain respectful communication
  • Follow agreed-upon policies and expectations

Failure to meet these responsibilities may result in termination of services.


10. Termination of Services

Either the patient or Hushed and Unheard, PLLC may terminate the Direct Primary Care agreement with written notice, subject to applicable law, continuity-of-care obligations, and the terms of the signed agreement. The practice may terminate services for:

  • Non-payment
  • Repeated missed obligations
  • Misuse of services
  • Disruptive, inappropriate, or threatening behavior

Termination does not entitle the patient to a refund.


11. Privacy & Payment Processing

Patient information is handled in accordance with HIPAA and applicable privacy laws.

Payments are securely processed through Stripe.
Hushed and Unheard, PLLC does not store full credit card information.


12. Limitation of Liability

To the fullest extent permitted by law:

Hushed and Unheard, PLLC shall not be held liable for:

  • Indirect or consequential damages
  • Costs incurred outside of the practice
  • Outcomes beyond the scope of services provided

All care is delivered in accordance with accepted medical standards without guarantee of specific results.


13. Changes to Terms

These Terms may be updated at any time.

Patients will be notified of material changes at least 30 days in advance.

Continued use of services after changes take effect constitutes acceptance of the updated Terms.


14. Governing Law

These Terms are governed by the laws of the State of North Carolina.
